Saddam Hussein's overthrow opened the opportunity to restore the basic right to a fair trial and to ensure, fairly, accountability for the crimes of the past. "It is an opportunity missed," said Amnesty International Sunday, "and made worse by the imposition of the death penalty."

Amnesty International "deplora la decisione dell'Alta Corte Penale irachena di infliggere la pena di morte Saddam Hussein e a due dei sette accusati dopo un processo che è stato profondamente difettoso e ingiusto". L'organizzazione per la tutela dei diritti umani ribadisce che il processo avrebbe dovuto apportare "un importante contributo al ripristino della giustizia e del rispetto del diritto in Iraq, e accertare verità e responsabilità per l'imponente violazione dei diritti umani da parte di Saddam Hussein", mentre è stato "un vergognoso affare, guastato da gravi lacune". Il processo, infatti, non richiedeva che la colpevolezza degli imputati venisse dimostrata "oltre ogni ragionevole dubbio" - formula usata nel sistema occidentale -, ma doveva solo "soddisfare" l'opinione del giudice. L'Alto commissario Onu per i diritti umani Louise Arbour ricorda che "ai condannati di oggi va garantita ogni opportunità per poter ricorrere in appello" e, qualunque sia il risultato dell'appello spera "che il governo osservi una moratoria sulle esecuzioni capitali".
